Assault, Threat of Force & Fighting Policy

Assault, understood as a physical attack against another person, is a serious offense and will result in dismissal or expulsion from the University. Threat of force, with or without physical contact, is also a serious offense, and may result in sanctions, including dismissal or expulsion. A threat of force includes any overt behavior accompanied by an intent on the part of the actor to do physical harm. Threat of force also includes any instance where the actions of one person directed towards another would lead a reasonable person to believe that the actor intended to do the other person imminent physical harm.

Fighting occurs when two or more students are engaged in physical attempts to harm each other. Although a student may not have instigated an altercation, a student is guilty of fighting if he or she goes beyond any force necessary to avoid harm and aggressively attempts to harm the instigator. Fighting may result in suspension or dismissal from the University.
